Terms of Service

These Terms of Service ("Terms") govern your use of services provided by Tekmatik LLC ("we," "us," or "our"). By hiring us or using our website, you agree to be bound by these Terms.

1. Services

Tekmatik provides IT installation services, including but not limited to:

Network cabling
Equipment setup and configuration
Hardware mounting
Related IT support services

Specific terms and scope will be outlined in individual quotes or project agreements.

2. Quotes & Payment

All pricing is provided in written quotes or invoices.
A deposit may be required before services are rendered.
Full payment is due upon completion unless otherwise agreed.
Payments must be processed within a grace period of 7 days from completion unless otherwise agreed.
Accepted payment methods include credit card, ACH, or check.

Late payments may incur a fee of $50 after 10 days, plus 1.5% monthly interest on the remaining balance until paid.

3. Cancellations & Rescheduling

Clients must provide at least 2 business days notice to cancel or reschedule a job. Cancelations or reschedules with less than 2 business days notice may be subject to loss of deposit or a cancellation/reschedule fee at Tekmatik's discretion
Cancellations within 5 business days may be subject to a fee of up to 15% of the job's total estimated value

4. Client Responsibilities

Clients agree to:

Provide safe, accessible, and secure work environments
Ensure power and internet are available, if required
Notify us of any hazards or restrictions on site
Obtain any necessary permissions or access to property

5. Warranty & Liability

We warrant our workmanship for 30 Days after installation. This does not cover:

User-caused damage
Third-party hardware malfunctions
Pre-existing system or wiring issues

To the fullest extent permitted by law, we are not liable for:

Indirect, incidental, or consequential damages
Loss of business or data
Delays caused by weather, site access, or third-party vendors

6. Right to Refuse or Discontinue Service

We reserve the right to refuse service, cancel work, or discontinue services at any time, for any reason, at our sole discretion. This right applies whether or not work has already commenced. In the event that services are canceled after work has begun, payment will remain due for all work performed up to the time of cancellation. Any fees paid in advance for work not yet performed will be refunded. We will not be responsible for any consequential, incidental, or indirect damages arising from the refusal or cancellation of services.

7. Client-Supplied Equipment and Materials

All equipment or materials supplied by the client must be pre-approved by Tekmatik prior to use. We reserve the right, at our sole discretion, to reject any client-supplied items that we determine to be of substandard quality, non-compliant with industry standards, or otherwise unsuitable for the project. In such cases, the client will be responsible for providing replacement materials at their own expense, or we may procure replacements and invoice the client accordingly.

Any delays in the shipment or delivery of client-supplied materials that result in project scheduling changes, work stoppages, or missed deadlines may result in additional charges via a formal change order, or in forfeiture of any deposit paid, at our discretion. The client acknowledges that timely delivery of approved materials is critical to maintaining the agreed project schedule.

8. Intellectual Property

Any designs, plans, or materials we provide remain our intellectual property unless explicitly transferred in writing.

9. Payment Terms & Late Fees

All invoices are due and payable in accordance with the terms stated on the invoice. Payments must be received by Tekmatik LLC no later than the due date to avoid being considered past due. For payments made by check, the payment date is the date of receipt by Tekmatik LLC, not the mailing or postmark date. Payments may be made by ACH or other approved methods as indicated on the invoice. Tekmatik LLC reserves the right to require deposits or progress payments for certain projects.

All invoices are due and payable according to the terms stated on the invoice. Any balance not paid within the agreed payment period shall be considered past due. Past due accounts will be subject to a late fee of $35 plus interest at the rate of 1.5% per month (18% APR) on the outstanding balance. A grace period of 5 days may be applied at Tekmatik LLC’s discretion.

Customer agrees that failure to pay invoices when due may result in suspension of services until the account is brought current. In the event of continued nonpayment, customer shall be liable for all reasonable costs of collection, including but not limited to attorney’s fees, court costs, and collection agency fees.

10. Website Use

By using our website, you agree not to:

Interfere with site functionality
Attempt to gain unauthorized access to any part of the site
Use our site or contact forms for spam or malicious activity

Content on our site is owned by Tekmatik LLC and may not be copied or reused without permission.

11. Termination

We reserve the right to refuse or cancel service for any reason, including unsafe working conditions, nonpayment, or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Colorado without regard to conflict of law principles.

13. Changes to Terms

We may update these Terms at any time. Continued use of our services after changes means you accept the revised Terms.
